MedTrackr User Agreement
This User Agreement (the “Agreement”) is entered into by and between MedTrackr Ltd (“Provider”, “we”, “us” or “our”), registered at 38 Lowe House, 12 Hebden Place, London, SW8 2FT, United Kingdom, and you (“User”, “you” or “your”). By accessing and using the MedTrackr platform and its associated services (the “Services”), you agree to be bound by the terms and conditions set out in this Agreement.
1. Definitions
Services: The MedTrackr platform and all associated functionalities, including but not limited to the tracking of professional work history, prescreening for employment, management of DBS records, certification and recertification reminders, realtime time card tracking, secure data sharing via expiring links, data import/export features, and access to the AI CV builder tool (subject to your subscription plan).
User Data: All information provided by you or generated through your use of the Services.
GDPR: The General Data Protection Regulation (EU) 2016/679, as applicable, together with the Data Protection Act 2018 and any subsequent amendments or regulations.
Secure Link: A time-limited, password-protected URL generated by the Service to facilitate the sharing, export, or import of User Data.
2. Scope of Services
MedTrackr is designed to support the professional development and employment processes of medical professionals by:
- Recording and managing your work history and qualifications for prescreening and employment verification.
- Maintaining records relevant to Disclosure and Barring Service (DBS) checks.
- Monitoring certification and recertification dates to provide timely reminders.
- Offering a realtime time card feature to track current job work history.
- Enabling secure sharing of your data with potential employers or hiring managers through expiring secure links.
- Allowing you to export or import your data securely via a protected link.
- Providing an AI-powered CV builder, available as part of certain subscription packages.
3. User Obligations
In using the Services, you agree to:
- Provide accurate, complete, and up-to-date information.
- Maintain the confidentiality of your login credentials and any secure links generated through the Services.
- Use the Services in accordance with all applicable laws and regulations.
- Not misuse or interfere with the Services, including attempts to circumvent or compromise security measures.
4. User Data and Privacy
Your data is collected solely for the purposes outlined in Section 2. We process your data in compliance with GDPR and the UK Data Protection Act 2018.
- You may share your information with potential employers or hiring managers via secure, time-limited links.
- You have the ability to export or import your data securely using a protected link.
- You may unsubscribe from communications at any time. You also have the right to request deletion of your profile; such requests will be actioned within 72 hours.
- We employ robust technical and organisational measures to protect your data. For more details, please refer to our MedTrackr Privacy and Data Policy.
5. Intellectual Property
All intellectual property rights in the Services, including software, design, content, or other materials provided by MedTrackr, are owned by or licensed to us. You are granted a non-exclusive, non-transferable licence to access and use the Services in accordance with this Agreement.
6. Limitation of Liability and Indemnification
MedTrackr shall not be liable for any indirect, incidental, or consequential losses arising from your use of the Services. Our total liability in relation to any claim shall be limited to the amount you have paid in the preceding 12 months.
You agree to indemnify and hold harmless MedTrackr Ltd, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Services or any breach of this Agreement.
7. Termination
This Agreement shall commence upon your acceptance and continue until terminated by either party.
- You may terminate your use of the Services at any time by providing written notice.
- MedTrackr reserves the right to suspend or terminate your access if you breach this Agreement or if required by law.
- Upon termination, your right to access and use the Services will cease. Obligations that by nature extend beyond termination will remain in effect.
8. Amendments
We reserve the right to amend this Agreement at any time. Any material changes will be communicated via the Services or through your registered contact details. Your continued use after such changes constitutes acceptance.
9. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Severability
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
11. Entire Agreement
This Agreement constitutes the entire agreement between you and MedTrackr with respect to the Services and supersedes all prior understandings.
