Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and MedTrackr Ltd (“MedTrackr”, “we”, “our”, or “us”), governing your access to and use of the MedTrackr website, applications, and related services (the “Services”). By registering for, accessing, or using the Services, you agree to be bound by these Terms.

1. Introduction

MedTrackr Ltd is a company registered in England and Wales under company number 16112074, with its registered office at 38 Lowe House, 12 Hebden Place, London, SW8 2FT. These Terms govern your use of our Services and prevail over any other terms which you seek to impose or incorporate.

2. Definitions

In these Terms:

  • “Platform” means the MedTrackr online system, applications, and associated tools.
  • “Subscription” means a paid plan (monthly or annual) which provides access to premium features of the Platform.
  • “User” means any person or entity who registers for or uses the Services.
  • “Content” means data, information, text, graphics, and other materials made available via the Services.

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract to use the Services. By creating an account, you confirm that the information you provide is accurate, complete, and kept up to date.

4. Account Registration and Security

To access the Services, you must create an account. You are responsible for safeguarding your login credentials and for all activity occurring under your account. You must notify us immediately of any unauthorised access. We reserve the right to suspend or terminate any account where we reasonably suspect misuse or breach of these Terms.

5. Subscriptions and Payments

Access to certain features requires a Subscription. By selecting a Subscription, you agree to pay the applicable fees and charges. All payments are taken in advance via your chosen payment method.

  • Monthly subscriptions: include a 7-day free trial. Unless cancelled within the trial, payment will be taken on the 8th day and monthly thereafter.
  • Annual subscriptions: include a 14-day cancellation period. Unless cancelled, payment will be taken on expiry of the 14-day period and annually thereafter.

By purchasing a Subscription, you authorise MedTrackr to take recurring payments until you cancel.

6. Cancellation and Refunds

Cancellations and refunds are governed by our Refunds & Cancellation Policy, which is incorporated into these Terms by reference. By accepting these Terms, you confirm you have read and understood that policy.

7. Intellectual Property

All intellectual property rights in the Platform and Services are owned by or licensed to MedTrackr. You are granted a limited, non-exclusive, non-transferable licence to access and use the Services for your personal or internal business purposes. You must not reproduce, copy, modify, or create derivative works from the Services without our express written consent.

8. Acceptable Use

You agree not to misuse the Services, including but not limited to:

  • Uploading unlawful, false, misleading, or harmful content;
  • Attempting unauthorised access to the Platform or related systems;
  • Introducing viruses, malware, or other harmful material;
  • Using the Services for any purpose that breaches applicable laws or regulations.

9. Data Protection and Privacy

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our Privacy Policy and Cookie Policy, available on our website, set out how we collect, use, and safeguard your data. By using the Services, you consent to such processing.

10. Service Availability

We do not guarantee that the Services, or any content, will always be available or uninterrupted. We may suspend, withdraw, or restrict the availability of all or any part of the Services for business, operational, or legal reasons.

11. Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under English law. Subject to this, MedTrackr excludes all implied warranties and shall not be liable for indirect, incidental, special, or consequential losses, including loss of profits, data, or business.

12. Third-Party Services

The Services may integrate with or link to third-party services. We are not responsible for third-party content, services, or policies, and your use of such services is at your own risk.

13. Governing Law and Jurisdiction

These Terms, their subject matter, and formation are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to resolve any disputes arising under them.

14. Changes to Terms

We may amend these Terms from time to time. Material changes will be communicated via our website or by direct notice. Your continued use of the Services after such changes constitutes acceptance of the amended Terms.
